Following a weeks-long trial, a court in June granted $15 million within damages to Depp and only $2 mil to Heard in their respective defamation legal cases.
Attorneys for Heard petitioned for a new test , claiming that information on the jury panel list delivered to counsel ahead of test did not appear to suit the demographics of just one of the jurors, and so compromised Heard’s rights to due procedure.
Determine Penney Azcarate stated in the court purchase filed Wednesday that will Heard’s rights in order to due process were not affected because simply no fraud or wrongdoing occurred in the court selection process.
“The juror was vetted, sat for the entire jury, deliberated, and reached a verdict. The only evidence before this Court is that this juror and all jurors adopted their oaths, the particular Court’s instructions, plus orders. This Court is bound with the competent decision of the jury, ” Judge Azcarate wrote.
When Heard’s legal group had an issue with the jury selection process, they should’ve addressed it during the weeks-long trial, Azcarate added.
“A party can not wait until getting an adverse verdict to object, for the first time, on an issue known since the beginning of test, ” the order states.
Attorneys designed for Depp filed a response memo against Heard’s post-trial motions last week ahead of the judge’s decision, calling the lawful arguments frivolous.
“While Ms. Heard slings an exceptional amount of mud in the wall in the hope that something may stick, the jury’s verdict on problems was perfectly good and supported from the evidence and account in this case, ” Depp’s memo stated.
Whent approached by CNN, associates for both Depp and Heard dropped to comment further on the judge’s order.
Heard’s appeal of the particular verdict is still pending.
