A 37-year-old man was given an almost 11-year sentence and 11 strokes of the cane on Tuesday ( Jun 11 ) for sexually assaulting a 17-year-old girl he had just met and who is described as having an “extremely low” IQ.
The person pleaded guilty , earlier this month to one count each of sexual abuse by infiltration and harassment. One abduct command was taken into account for punishment.
In order to reduce the victim’s recognition, a court order prohibits the offender, the victim, and the witnesses from being named.
District Judge Shaiffudin Saruwan described the sufferer as being extremely vulnerable due to her intellectual state and handed down a statement of 10 times, 11 weeks, and 11 canes.
The accused were aware that the sufferer was intellectually untypical. He abused her in a sexual way as a result of this. The physical abuse was egregious”, he said.
The target repeatedly expressed her condemnation, but the judge noted that the man had continued to act despite the victim’s repeated showing of criticism.
” His physical oppression clearly impacted her grief and trauma.”
WHAT HAPPENED
According to judge papers, the victim suffers from “moderately- serious” academic illness. She is assessed to have an IQ of 44, which falls within the “extremely small” range of knowledge.
At the time of the crime, which occurred in June 2020, she was 17 years older.
The girl had a near relationship with her mother’s friend, a 34- year- aged woman identified in court documents as W1, and the woman’s 36- year- ancient boyfriend, W2.
Sometime in the evening of Jun 29, 2020, the target texted W1 saying that she was bored. W1 and W2 finally brought the target to their product.
That evening at about 9pm, the criminal, a friend of W1 and W2 , who , frequently visited their house to have coffee, came over with vodka. This was the first time he had a conversation with the victim.
He was aware that the victim was intellectually abnormal after his two friends had pointed out that the victim was” special.”
According to Deputy Public Prosecutors James Chew and Tin Shu Min,” the accused also observed this from his interactions with the victim.”
The offender then requested the victim accompany him to a nearby store two hours later. W1 instead proposed that all four of them went together as she , was” cautious” about the victim’s safety, owing to her intellectual disability.
Upon returning to the unit, W1 needed to use the toilet. Her boyfriend W2 assisted her, as she was wheelchair- bound.
The victim entered the bedroom and sat on the bed while the two “were in the toilet for a short while.”  ,
According to court records, the offender followed her into the room and took his jeans out because they were wet. He sat next to the victim while wearing a pair of shorts.
He sexually assaulted her there before removing her shorts and panties to have sex with her.
The victim continued to violate his offending when the victim attempted to pull up her shorts and panties.
” Throughout this time, the victim felt scared. She kept quiet and did not react to the accused’s actions”, said the prosecutors, adding that the victim also suffered physical pain due to the man’s actions.
Only when he heard the toilet door opening, the man stopped his actions.
W1 later discovered that the victim and the man were lying on the bed together. She also noticed that the victim was wearing only shorts and that the victim was partially covering her face.
Seeing that the victim was crying, W1 lay on the bed and hugged her. The victim then informed the woman that the offender had harmed her by typing on her handphone and then showing it to W1.
Before the victim left the following morning, the victim and the offender had slept over in the unit the night before.
W1 ran into the victim’s mother on Aug 4, 2020, and informed her about what happened to her daughter. The mother notified the police the following day about the situation. The man was also detained the following day.
The man could have received a 20-year sentence for sexual assault with penetration as well as a fine or a caning.
For outrage of modesty, the man could have been jailed for up to two years, caned, fined or be given any combination of the punishments.
