Chousak Sirinil, the vice president of the Pheu Thai Party, suggested that the government, the opposition, and Senate paddles all petition the Constitutional Court for a constitutional change.
His request came inainte of the legislature’s scheduled second studying of more than a few law act bills scheduled for Feb. 13 and 14. The government, criticism, and Senate whip met on Thursday to plan for the discussion.
While most of these bills involve section-by-section changes, two of them, sponsored by the ruling party and the main opposition People’s Party ( PP ), seek wholesale charter changes that require a referendum.
How many referendums are necessary for the broad contract amendments to become recognized by law, in essence? The Constitutional Court must decide the matter.  ,
According to Mr. Chousak, a Constitutional Court decision may be sought under Area 210 of the contract, and a complaint for judicial review may be filed by either MPs or lawmakers.
Since the mandate article bills have been put on the parliament’s plan by its leader, Wan Muhamad Noor Matha, he said, it is irrelevant whether the plea be filed before or after the arranged meeting.
Due to a 2021 decision by the Constitutional Court involving the mandate update process, the payments that want to make extensive changes must be voted on.
The judge stated that the electorate has first elect a new charter through a referendum.  ,
A bill establishing a charter drafting assembly ( CDA ) was rejected by parliament in its third and final reading following the ruling because it failed to receive enough support from the House and the Senate.
Nevertheless, the 2021 decision does not identify how many rounds of election are required. Some people believe two shells are sufficient, while some favor three rounds as being secure.
Asking people for their opinions on the amended charter is one of the two election calls. A subsequent referendum may follow if the first one was approved, allowing voters to choose which to approve.
With the three-referendum idea, the first round would ask voters if they agree with a mandate update, a minute on whether Area 256 of the constitution, which makes way for the setting up of a CDA, needs amending, and a second round on whether voters ‘ support for a new charter may be adopted.
Mr. Chousak argued that a Constitutional Court decision would remove the uncertainty.
If doubts persist regarding the referendum, it will also ease concerns that MPs and senators may have about whether to withdraw from the charter amendment business out of fear of breaking the law.  ,
Mr Chousak, however, said that it is too early to say which draft, between the party’s version and the PP-sponsored one, will be adopted as the main draft.
