Govt wants suggest over generals’ choice

The Defense Ministry Administration Act, which may lower the government’s authority to hold coupsd’etats, has been proposed by the Pheu Thai Party.

Instead of allowing military army commanders to appoint officials close to them as generals, the laws will enable a cabinet-appointed committee to acquire and assign generals.

He added that the act also added requirements that must be met by all those seeking to be generals under Section 25, including not being known for exerting undue influence or having connections to illegal drugs, human smuggling, or the loss of natural resources and the surroundings. The prime minister would be the Defence Council president rather than the defence minister, he said.

Other qualifications include not participating in a disciplinary investigation or criminal trial, aside from for crimes committed by carelessness, defamation, or slight crimes, and not being a legal partner with a ministry of defense unit or running a business or undertakings related to the ministry.

In addition, the bill amends Section 35 by enforcing a prohibition against using military force or military personnel in situations where the government is seizing or enforcing its managerial power, including preventing the use of it for business or for operations that the commander finds to be personally beneficial, and committing additional unlawful acts.

Additionally, it was stated that military commanders who were ordered to carry out such deeds had the right to refuse to do so and could be seen as a group to a military-related criminal offense.

Additionally, it raises the charges for military officials who violate Part 35 or are suspected of intending to do so by temporarily suspending them in order to allow for an investigation.

The addition of Segment 35 is crucial in preventing the defense from abusing its position and acting in opposition to a political system with the King as head of state, he said.
