Thin Muhamad Noor Matha, the head of the legislature, defended his decision on Monday to put bills calling for fundamental constitutional changes directly on the agenda without having a first-ever parliamentary vote. He claimed that he had never violated any laws.
The bills are among the few that will be deliberated in their first observations on Thursday and Friday, which many people believe would sum to a redrafting of the charter. Physically, the expenses require a vote following the Constitutional Court’s decision in 2021 regarding the procedure for creating a new charter.
Nevertheless, the 2021 decision does not identify how many referendum sessions are required.
Mr. Wan claimed to have spoken with the state, the opposition, the Senate whips, and the cabinet members before the majority of them had concurred that the conversation should continue despite no referendum being held first.
He cited a previous decision by the Constitutional Court to back up his decision to include bills attempting to amend Section 256, which made it possible to establish a charter drafting assembly ( CDA ) on the agenda.
I put them on the budget-saving objective for discussion. If parliament accepts the bills for further examination, I will then put the entire process on hold and ask the Election Commission]EC ] to hold a referendum.
However, if the election is held first and is approved but afterwards rejected by congress, it means the three billion rmb spent on planning the referendum will go to waste, he said.
He added that a group of 40 senators or MPs may petition for a new Constitutional Court decision regarding the necessity of a vote.
Prior to the scheduled conversation, Chousak Sirinil, the vice president of the Pheu Thai Party, stated that a movement asking the Constitutional Court to rule on how many referendums are necessary for a charter rewrite may be made.
The movement is anticipated because two of the main opposition parties ‘ proposals for universal mandate changes call for elections, according to the ruling celebration and the ruling party.
According to Mr. Chousak, parliament will deal with the first observations as scheduled, but there is a chance that a request for court action might be made. He added that the action must have at least 40 people ‘ support in order for it to pass under the 31st parliament regulation.
In order to lessen worries about violating the 2021 judge judgement, Mr. Chousak suggested last week that the government, the criticism, and Senate whip should all petition the Constitutional Court for a decision.
Legislators and some political parties may choose to violate the decision, according to him, and he said that they are concerned about this. He noted, however, that the paddles have not yet decided whether to appeal a choice.
In the meantime, a group that fights for charter read legislation wrote a letter to the Senate on Monday, asking it to vote for the costs without worrying about a vote.
A law article bill must have the support of one-third of senators, according to the constitution. The email was accepted by Sen Pist Apiwattanpong.
