NO LEGAL BASIS
The Indonesian government’s foreign government has stated on numerous occasions that it has no overlapping authority with China and is a non-claimant position in the South China Sea.
The ministry stated on Monday that its position had remained intact and that the deal may not affect its sovereign rights.
” Indonesia reiterates its position that those ( Chinese ) claims have no international legal basis”, it said.
” The agreement does not affect sovereignty, sovereign right or Indonesia’s authority in the North Natuna Sea”.
The section” clarifies the democratic consensus and the way of cooperation between the two sides on joint advancement in the clashing maritime areas claimed by the two countries,” according to China’s international ministry.
Indonesia and China will continue to investigate issues like the content and method of cooperation, according to a ministry spokesman Lin Jian, adding that there is a traditional foundation for China’s claims in the South China Sea and that both countries would gain from consensus.
China’s U-shaped series, based on its old drawings, begins off northern Vietnam and runs into lakes off Indonesia’s Natuna territories, more than 1, 000km south of the island of Hainan.
It is surrounded by a Chinese coast guard fleet, which neighbors accuse of waging a fight against vitality and fishing activity, and it borders Brunei, Malaysia, the Philippines, and Vietnam.
China normally asserts that its ships are preventing invasion of its place.
The Indonesian government’s foreign government hoped the financial agreement with China would serve as a model for preserving peace and friendship and covered fisheries and tuna conservation.
Some Indian analysts, yet, said signing for an agreement may include repercussions and become interpreted as a shift in stance.
” If we refer to the standard shared statement, that means we recognise overlapping statements”, said sea scientist Aristyo Rizka Darmawan, adding it may compromise Indonesia’s sovereign right to abuse resources in its EEZ.
He added that Indonesia does have signed the deal in order to boost economic relations.
Klaus Heinrich Raditio, a professor in Chinese elections, said Indonesia always had overlapping promises to begin with and the clause’s participation in the speech was “inappropriate”.
” This joint statement puts our national interests at risk”, he said, adding that it could still be renegotiated.
