Ratray, who denied the allegation inside a phone call with CNN, is currently facing domestic violence charges coming from an unrelated event in Oklahoma final December involving their then-girlfriend. He has pleaded not guilty in that case and it has an upcoming hearing fixed for October.
It had been the news of Ratray’s arrest in Oklahoma that prompted Lisa Smith to contact prosecutors about a police record she had submitted in 2017, accusing the actor of raping her within New York City. She wanted to know why the girl case hadn’t been pursued. Prosecutors, she said, incorrectly believed she wanted to stay anonymous and didn’t want to press charges. As a result, the case was closed, she stated she was informed.
Smith, who also contacted CNN, stated she was “devastated” that authorities did not fully investigate her allegation when she initially came forward. She provided emails that suggest the case was closed despite the fact that she had taken steps to cooperate with all the investigation, traveling through out of state to become interviewed by researchers at the Manhattan Region Attorney’s Office and later providing a dress she wore over the night of the alleged assault for possible DNA testing.
Ny police declined to address questions from CNN about the handling of the case.
