Saranya Chamni, 45, is then faced with a devastating choice: whether to let her daughter Nong Cartoon to maintain her legal and medical battle or allow her to spend her final days in peace. A tragic car crash left her family forever.
How it got started
When Namphueng Jaisangiam, then 22, lost control of her changed pickup truck and crashed into the” Lung Yai Steakhouse” at the entrance to Soi Ekkachai 119 in Bangkok’s Bang Bon region on September 19, 2014, she was involved in illegal street racing.
The factory owner, Phanuthat Saksitphan, 42, the husband of Ms. Saranya, died using his system to protect their five-year-old child, Narasiri, warmly known as Nong Cartoon.
Despite the effect, Nong Cartoon was left with severe mental trauma. She lost her perspective, communication skills, and 75 % of her brain functions. She has been sick for more than ten years because of her condition, which necessitated ongoing medical care.
She continues to pay for her attention, then totaling at least 1.9 million ringgit.
Namphueng, then known as Wanthanan Phiewkliang, the pilot, has allegedly lied to give any damages or not taking duty.
Saranya, Nong Cartoon’s family, has been surviving alone for the past 11 years as she has since vanished, leaving her to bear the cost.
A protracted legal battle
Namphueng received a two-year, six-month prison sentence from the Thonburi Criminal Court on August 18, 2015. Her statement and lack of prior legal history led to her reduction from the word to a year.
Additionally, she was ordered to pay 6.3 million baht in payment to the home of Nong Cartoon and fined 3, 000 baht. Nong Cartoon’s home has not yet received any communication from Namphueng despite her release from prison.
On one occasion, when Namphueng paid 40, 000 ringgit for damage to her shop, Ms. Saranya just received the money that she had.
Namphueng posted a message on her Instagram on December 27, 2014, saying,” I wasted day with this mother and daughter at the brisket store. My vehicle was ruined after I paid for it. Who will be paying for that? You are egotistical, foolish people. I’m only complaining, sorry. I’ll bend it out until the statute of limitations expires, so I won’t be able to spend what they asked for, haha!
The 10-year statute of limitations expired on September 19, 2012, next month. Namphueng allegedly had no goods, so she denied making any payments. Some claim that she transferred her possessions to others before receiving her punishment.
None of the financial aid received by the defendant has helped ease the burdens of Ms. Saranya, whose care costs once amounted to 100, 000 baht per month.
Ms. Saranya made the decision to resume the steak in the Ratburana district in an effort to help her daughter’s ongoing treatment. Additionally, she established a Instagram page where she constantly updates her 219, 000 fans about the legal proceedings and mother’s problem. Additionally, when needed, the website was used to make gifts.
Stay fighting.
Nong Cartoon claims she has a serious lung disease and is unable to inhale on her own in a recent update on her mother’s problem.
She has been receiving medical attention for three days. Her child may require a vent for the rest of her career, according to a doctor.
At one level, Ms. Saranya considered giving up and allowing her child to slip away peacefully. She shared this agonizing thought on social media, which sparked widespread condemnation of the justice system, which had failed to provide for the mother and the severely injured child.
Rukchanok Srinork, a People’s Party MP from Bangkok, highlighted the glaring unfairness in the program and the stark contrast between Ms. Saranya’s and Namphueng’s lives, who have posted images of herself and her spouse enjoying a luxurious lifestyle.
According to Ms. Saranya, who was later interviewed by the advertising,” I thought about letting her go, believing that Nong Cartoon has suffered much, being ill for 11 years. I called her name the other day when I visited her. She nodded off, opened her eyes, and looked for the audio. Her hands shook.
I decided that if her state improved enough for me to leave the hospital, I’ll take her home and take care of her myself because it became so difficult to let her go. I’m currently looking for a fresh constitutional strategy to sue the perpetrator, she said.
Finding a alternative
Justice Minister Pol Col Tawee Sodsong again expressed his concern for the judgment’s protection. There is a 10-year statute of limitations on decisions under the Civil and Commercial Code, with the plaintiff ( in this case, Nong Cartoon ) required to launch an asset investigation against the driver.
Although the 10-year protection period has come to an end, her family may also ask the court to extend the time for the motorist who struck Nong Cartoon’s resource investigation. Because this situation involves human rights, he needed to research legitimate guidelines relating to the” Justice Fund” to see what kind of assistance might be offered.
Kosolwat Inthuchanyong, director-general of the Office for Rights Protection, Legal Aid, and Enforcement of Judgments under the Office of the Attorney General, made a second advice.
He claimed that Ms. Saranya can also bring charges of false concealment of assets against creditors even though the legal situation has passed the statute of limitations.
According to him,” This can be pursued by investigating the transfer of resources by Namphueng, as for payments may be supported by evidence.”
