Cocaine charge against fugitive Red Bull scion has lapsed

The charge of cocaine abuse introduced against Red Half truths heir Vorayuth “Boss” Yoovidhya during the high-profile hit-and-run case this year has now lapsed because the statute of limitations has expired under recent changes in order to narcotics offences laws and regulations, Office of the Lawyer General spokesman Prayut Petcharakhun said upon Tuesday.

Mr Prayut mentioned Mr Vorayuth had been charged with cocaine abuse in addition to reckless driving causing loss of life by a panel of prosecutors set up to review the case in Aug 2020. A court warrant was then issued for their arrest under the Drugs Act of lates 1970s, of which Section fifty eight prohibited use of crack. A violator was liable to a jail term of six months to three years and the statute of limitations was 10 years.

In Mister Vorayuth’s case, the particular statute of limitations on the cocaine charge was originally in order to expire on September 3, 2022.

But when new narcotics laws took effect from Dec 9, 2021, the particular Narcotics Act associated with 1979 was cancelled. Under Section 162 of the new regulation, which also prohibits use of cocaine, a violator is liable to a jail term as high as one year and the law of limitations is usually five years.

As a consequence, the charge of crack abuse against Mr Vorayuth has immediately lapsed.

The only remaining cost against Mr Vorayuth now is reckless driving causing death under Section 291 from the Criminal Code, which carries a penalty of up to 10 years in jail and the statute of limitations is fifteen years.

The statute of limitations on the reckless driving charge is due to expire on September 3, 2027.

Mr Vorayuth, then 27, was driving a black Ferrari that strike a motorcycle powered by Pol Snr Sgt Maj Wichian Klanprasert, 47, and killed him within the early morning of Sept 3, 2012.

He damaged into the rear of the police motorcycle on Sukhumvit Road. He then fled the picture to his house nearby.

He, through his lawyers, put off listening to charges seven occasions. It was not till April 27, 2017, that prosecutors finally charged him along with reckless driving causing death and screwing up to stop and help a crash victim.

He fled on a private airplane two days before this individual was due to face the charges.

A boosting charge was afterwards dropped when the one-year statute of limitations expired. The charge of failing to stop and render help expired on Sept 3, 2017.
